1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Digital Systems ("BabelPage", "we", "us"), governing your access to and use of the BabelPage websites, apps, and services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
BabelPage scans document pages, performs optical character recognition, and produces page-faithful translations — including the labels inside diagrams and figures — which you can export. Features, limits, and availability depend on your plan and may change over time.
3. Your account
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. Notify us promptly of any unauthorized use.
4. Plans, billing, and refunds
Paid plans (Everyday, Pro, Scale) and one-off credit top-ups are billed through our payment processor, Stripe. Subscriptions renew automatically each cycle until cancelled. You can upgrade, downgrade, or cancel at any time from your subscription settings; changes take effect at the start of your next cycle.
Fees are stated exclusive of taxes, which we add where required. Except as required by law or expressly stated here, payments are non-refundable. If you believe you were charged in error, contact us within [REFUND WINDOW] and we will review your request in good faith.
5. Acceptable use
You agree not to: (a) upload content you do not have the right to use; (b) use the Service to infringe intellectual property or privacy rights; (c) attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; (d) use the Service to process content that is unlawful, or to produce material that violates our policies; or (e) resell the Service without our written permission.
6. Your content
You retain all rights to the documents and content you upload ("Your Content"). You grant us a limited licence to host, process, and transmit Your Content solely to provide the Service to you — for example, to run OCR, translation, and export. We do not sell Your Content, and we do not use it to train third-party models. You are responsible for Your Content and for having the rights necessary to process it through the Service.
7. Our intellectual property
The Service, including its software, design, and trademarks (such as the BabelPage name and logo), is owned by us or our licensors and protected by law. These Terms grant you no rights to our intellectual property except the limited right to use the Service.
8. Third-party services
The Service relies on third-party providers to function (for example, cloud hosting, OCR, AI translation, payments, and email). Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.
9. Disclaimers
The Service is provided "as is" and "as available". Translations are produced by automated systems and may contain errors; you are responsible for reviewing output before relying on it. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us in the [12] months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising out of Your Content or your misuse of the Service or violation of these Terms.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends and we may delete Your Content in accordance with our data-retention practices.
13. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app). Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Republic of Zambia, without regard to its conflict-of-laws rules. The courts of Lusaka, Zambia will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
